​What if I want to get rid of a bypass trust?
 
If there is no longer a need for it, you can get rid of it by re-executing or executing a new last will and testament that doesn’t include a bypass trust. That would be the easiest way to get rid of the bypass trust. If a husband and wife created a bypass trust and then one of the spouses died, the surviving spouse still get rid of a bypass trust. If a spouse is no longer living and the spouse wants to modify the trust or terminate it, it would require court approval if the grantor has already passed away.
