What if I want to get rid of a bypass trust?
If there is no longer a need for it, you can get rid of it by re-executing or executing a new last will and testament that doesn’t include a bypass trust. That would be the easiest way to get rid of the bypass trust. If a husband and wife created a bypass trust and then one of the spouses died, the surviving spouse still get rid of a bypass trust. If a spouse is no longer living and the spouse wants to modify the trust or terminate it, it would require court approval if the grantor has already passed away. If you have any questions or would like me to review the trust, please contact our office.
